These Terms of Service (“Terms”) govern your access to and use of trulyform, including the website, editor, account area, published forms, and related services (together, the “Service”). By creating an account, using the Service, or answering a form, you agree to these Terms. If you use the Service for an organization, you confirm that you can accept these Terms for that organization.

1. What trulyform does

trulyform helps you start with a template, shape the questions and logic, publish a form, and collect responses. You can try the editor before creating an account. An account is required to keep work in your account and publish forms. Features, limits, and availability can differ by plan and may change over time.

2. Your account and organization

• Keep your account information accurate and protect your sign-in credentials.
• You are responsible for activity under your account and for the people you invite to your organization.
• Organization owners and members may be able to create, edit, publish, view, export, or delete shared content according to their access in the Service.
• Tell us promptly if you believe an account or organization has been accessed without permission.

3. Your content and response data

You keep ownership of the forms, questions, branding, files, and other content you submit (“Your Content”). You give trulyform the limited worldwide permission needed to host, copy, transmit, display, back up, and otherwise process Your Content to provide, secure, and improve the Service. This permission ends when the relevant content is deleted, except for limited copies retained for security, legal, or backup purposes.

You are responsible for Your Content and for your forms’ notices, permissions, consent language, lawful basis, retention choices, and response access. Do not collect information through a form unless you have the right and authority to do so. If you answer someone else’s form, that creator is responsible for the form and its response data.

4. Acceptable use

You may not use the Service to:

• break the law, infringe another person’s rights, or deceive, harass, threaten, or harm someone;
• collect or distribute malware, credentials, payment details, or highly sensitive information without appropriate safeguards and authorization;
• send spam, unsolicited marketing, or unlawful communications;
• upload content that infringes intellectual property, privacy, publicity, or confidentiality rights;
• probe, scan, disrupt, overload, reverse engineer, or bypass the Service or its limits;
• access another organization’s forms, responses, files, or account; or
• use the Service to build a competing service or dataset without our written permission.

5. Plans, allowances, and billing

The current plans and prices are shown on the homepage or at checkout. Paid plans are billed through Stripe and renew according to the billing interval shown when you subscribe until cancelled. You authorize the applicable charges, taxes, and lawful adjustments. Stripe handles payment details and may apply its own terms and privacy policy.

Response allowances are measured by the first nonempty answer saved for a response, including an unfinished response. Editor previews and views do not count. Deleting a response does not restore an allowance. Storage and feature limits apply by plan. We do not silently charge for extra responses or delete existing responses and files solely because an allowance is reached, a plan changes, or a subscription ends.

6. Free trials, cancellation, and refunds

You can cancel a paid plan using the billing controls made available in the Service. Cancellation normally stops the next renewal and does not erase your forms, responses, or files. Unless a checkout page or mandatory law says otherwise, fees already paid are not refundable. If a payment fails or a subscription ends, access to paid features may change to the applicable free-plan limits.

7. Privacy and security

Our Privacy Policy explains how we handle information. You are responsible for telling respondents how their information will be used and for honoring requests about the response data you collect. We use safeguards designed to protect the Service, but you should not treat trulyform as a substitute for your own security, backup, compliance, or incident-response program.

8. Intellectual property

The Service, its software, visual design, templates supplied by trulyform, trademarks, and related materials belong to Trulyform or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service while you comply with these Terms. You may use a form you create for your own business or work, subject to the rights of anyone whose content or branding you include.

9. Feedback

If you send us suggestions or ideas, you allow us to use them without restriction or payment, provided we do not identify you publicly without permission.

10. Suspension and termination

We may limit or suspend access when reasonably necessary to protect the Service, investigate abuse, comply with law, or address a serious breach of these Terms. Where practical, we will give notice and an opportunity to fix the problem. You may stop using the Service at any time. Sections that should continue by their nature—including ownership, payment obligations, acceptable use, disclaimers, limits of liability, and dispute terms—will survive.

11. Availability and changes

We are building trulyform to be useful and dependable, but we do not promise that the Service will be uninterrupted, error-free, or available in every location. We may add, remove, or change features, limits, plans, and templates. We will not intentionally remove access to existing data solely as a consequence of a plan change, but you should keep exports or backups appropriate for your work.

12. Disclaimers and liability

To the fullest extent permitted by law, the Service is provided “as is” and “as available”. We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. trulyform is not legal, financial, medical, employment, or compliance advice.

To the fullest extent permitted by law, Trulyform will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data. Our total liability for claims arising from the Service will be limited to the maximum extent permitted by applicable law, except where the law does not allow that limit.

13. General terms

These Terms and the Privacy Policy are the agreement between you and Trulyform about the Service. If a provision is unenforceable, the remaining provisions remain in effect. We may assign these Terms as part of a merger, reorganization, or sale of the Service. You may not assign them without our consent. Mandatory consumer protections in your place of residence are not limited by these Terms.
